Read this before engaging any Athletics Anonymous service. By submitting a qualifier application or purchasing coaching, you agree to these terms.

Important: This document constitutes a legally binding agreement between you and Athletics Anonymous. It has been prepared as a comprehensive framework and should be reviewed by a licensed attorney before formal reliance. Athletics Anonymous is a fitness and wellness coaching business — not a medical practice, clinic, or licensed healthcare provider.

Section 01

Parties and Scope

1.1 Service Provider

Athletics Anonymous is a fitness and wellness coaching business operated by Jordan Richey, ISSA-CPT ("Coach"). Athletics Anonymous is not a medical practice, clinic, hospital, or licensed healthcare provider. The Coach is a certified personal trainer — not a physician, registered dietitian, licensed nutritionist, pharmacist, or any other licensed medical or clinical professional.

1.2 Client

"Client" refers to any individual who engages, purchases, or participates in any service offered by Athletics Anonymous, including but not limited to: BioSync coaching engagements, training program delivery, check-in services, content access, or consultation calls.

1.3 Geographic Scope

Services are provided remotely via online platforms and are available to clients in the United States. Clients outside California are responsible for verifying that the services provided comply with the laws of their state or jurisdiction. The Coach's scope of practice is governed by California law and the ISSA Code of Professional Conduct.

Section 02

Scope of Services

2.1 Services Provided

Athletics Anonymous provides the following wellness and fitness coaching services:

  • Personalized exercise programming and training plan design
  • Training periodization and progressive overload guidance
  • General wellness coaching and behavior change support
  • Review and contextual discussion of client-shared health data, including bloodwork results voluntarily provided by the client
  • General education regarding nutrition, supplementation, and lifestyle factors as they relate to fitness performance and wellness
  • Referral coordination with third-party clinical providers, including Hone Health

2.2 Explicit Scope Limitations — What We Do NOT Do

The following services are explicitly outside the scope of Athletics Anonymous and will not be provided under any circumstances:

  • Diagnosing, treating, curing, or preventing any disease, disorder, injury, or medical condition
  • Prescribing medications, hormones, controlled substances, or any pharmaceutical compounds
  • Providing medical nutrition therapy (MNT) as defined under state law, including condition-specific dietary intervention for diagnosed medical conditions
  • Interpreting bloodwork for the purposes of clinical diagnosis
  • Replacing the advice, care, or supervision of a licensed physician, registered dietitian, or other licensed healthcare provider
  • Making representations that any supplement, dietary strategy, or training protocol will cure or treat any disease or medical condition
  • Acting as a Business Associate (as defined under HIPAA) to any covered entity, unless a formal Business Associate Agreement is executed

2.3 Bloodwork-Informed Coaching — Clarification of Role

When a client voluntarily shares bloodwork results obtained through Hone Health or any other clinical provider, the Coach uses that information to:

  • Inform general training load recommendations (e.g., recovery, intensity adjustments)
  • Provide general wellness education regarding the markers shared
  • Identify trends relevant to performance and recovery
  • Refer the client back to their clinical provider when any marker warrants medical attention

The Coach does not interpret bloodwork results in a clinical capacity and does not modify, override, or second-guess the prescribing physician's clinical decisions. Any supplement or nutritional guidance provided is general wellness education — not medical nutrition therapy or clinical recommendation.

2.4 California Nutrition Disclosure

Pursuant to California Business and Professions Code § 2068:

"State law allows any person to provide nutritional advice or give advice concerning proper nutrition — which is the giving of advice as to the role of food and food ingredients, including dietary supplements. This state law does NOT confer authority to practice medicine or to undertake the diagnosis, prevention, treatment, or cure of any disease, pain, deformity, injury, or physical or mental condition and specifically does not authorize any person other than one who is a licensed health practitioner to state that any product might cure any disease, disorder, or condition."
Section 03

Client Bloodwork and Health Data

3.1 Voluntary Disclosure

Any and all health data — including bloodwork results, hormone panels, metabolic panels, or other clinical information shared with the Coach — is shared voluntarily by the client. The Coach does not solicit, receive, or access protected health information (PHI) directly from Hone Health, any laboratory, or any other covered entity.

By sharing bloodwork or health data with the Coach, the client represents that:

  • The information belongs to them or they have legal authorization to share it
  • They are sharing it voluntarily and without coercion
  • They understand the Coach is not a HIPAA covered entity, though the Coach is committed to maintaining strict confidentiality of all health data
  • They have been advised by their clinical provider of their lab results and understand what those results indicate clinically

3.2 No Clinical Override

Sharing bloodwork results with the Coach does not replace, modify, or supersede any clinical recommendation made by the client's treating physician at Hone Health or any other medical provider. The client agrees to follow the clinical guidance of their licensed physician and to use the Coach's input as a complementary, non-clinical layer of support.

3.3 Referral Protocol

If the Coach identifies any health data, symptom, or client report that suggests a potentially serious medical issue, the Coach will direct the client to consult their physician immediately. The Coach reserves the right to pause or modify services until the client has received medical clearance from a licensed provider.

Section 04

Assumption of Risk and Liability Waiver

4.1 Inherent Risks

The client acknowledges that participation in exercise programming and physical training carries inherent risks, including but not limited to: musculoskeletal injury, cardiovascular events, falls, equipment-related injuries, overexertion, and in rare cases, death. These risks exist regardless of the quality of instruction provided.

4.2 Medical Clearance

The client represents and warrants that they have been cleared by a licensed physician to participate in moderate-to-vigorous physical exercise. If the client has any diagnosed medical condition, is currently taking prescription medications, has recently undergone surgery, or has any other health concern, they agree to obtain written medical clearance before beginning any program designed by the Coach.

4.3 Release of Liability

To the fullest extent permitted by applicable law, the client voluntarily releases, discharges, and holds harmless Athletics Anonymous and Jordan Richey from any and all claims, demands, causes of action, or damages arising from or related to:

  • Participation in exercise programming designed or recommended by the Coach
  • Injuries sustained during or after training sessions
  • Implementation of nutritional or supplemental guidance provided by the Coach
  • Use of or reliance on any information, content, or program materials provided by the Coach
  • Any outcome or failure to achieve a desired result from coaching services

4.4 Limitation of Liability

In no event shall Athletics Anonymous or Jordan Richey be liable for any indirect, incidental, special, consequential, or punitive damages. In the event that any direct liability is established, the maximum aggregate liability of Athletics Anonymous shall not exceed the total fees paid by the client in the 90 days preceding the claim.

4.5 Indemnification

The client agrees to indemnify and hold harmless Athletics Anonymous and Jordan Richey from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from the client's use of services, breach of these Terms, violation of applicable law, or misrepresentation of health status.

Section 05

Client Responsibilities

The client agrees to:

  • Disclose all relevant health conditions, injuries, medications, and clinical protocols prior to beginning services
  • Inform the Coach of any changes to their health status, medications, or clinical protocols during the engagement
  • Consult their physician before implementing any significant change to nutrition, supplementation, or training load
  • Follow the guidance of their licensed physician where it intersects with coaching recommendations
  • Not engage in any exercise program designed by the Coach if their physician has advised against exercise
  • Provide accurate and complete health information — the Coach's ability to provide appropriate guidance depends entirely on the accuracy of the information disclosed
Section 06

No Guarantees of Results

The client acknowledges that fitness, body composition, hormonal optimization, and health outcomes are influenced by factors outside the Coach's control, including genetics, medication response, adherence, lifestyle factors, sleep, stress, and clinical variables managed by their physician. Athletics Anonymous makes no guarantee of any specific result. Testimonials shared on the website or social media represent individual experiences and are not a promise or guarantee of outcome.

Section 07

Third-Party Clinical Relationships — Hone Health

7.1 Nature of Relationship

Athletics Anonymous has a referral relationship with Hone Health. The Coach may refer clients to Hone Health for hormone optimization, bloodwork, and clinical services. This referral relationship does not make Athletics Anonymous an agent, employee, or clinical affiliate of Hone Health. The Coach does not receive access to the client's Hone Health account, medical records, or physician communications unless the client voluntarily shares that information directly.

7.2 Clinical Responsibility

All clinical decisions, prescriptions, and medical oversight related to Hone Health services remain exclusively within the purview of Hone Health's affiliated licensed physicians. The Coach has no authority to modify, approve, or override clinical decisions made by Hone Health providers.

7.3 No Warranty of Third-Party Services

Athletics Anonymous makes no representation or warranty regarding the quality, accuracy, or outcomes of Hone Health's services. The client's relationship with Hone Health is governed by Hone Health's own terms of service, informed consent agreements, and clinical policies.

Section 08

Payment, Cancellation, and Refunds

8.1 Payment Terms

Coaching engagements are billed as set forth in the client's service agreement. Payment is due prior to program delivery unless otherwise agreed in writing. All fees are in USD.

8.2 Cancellation

  • Cancellations prior to program delivery: full refund minus any administrative processing fees
  • Cancellations within the first 7 days of program delivery: 50% refund
  • Cancellations after 7 days of program delivery: no refund for the current billing period

8.3 Coach's Right to Terminate

The Coach reserves the right to terminate services immediately if the client misrepresents their health status, engages in abusive or threatening behavior, fails to disclose a material medical condition, or violates any provision of these Terms. Coach-initiated termination for cause: fees non-refundable. Coach-initiated termination without cause: pro-rated refund for unused services.

Section 09

Intellectual Property

All program materials, training plans, content, tools, templates, and educational resources provided by Athletics Anonymous are proprietary and protected by copyright. The client may use them for personal use only. Reproduction, redistribution, resale, or sharing with third parties is prohibited without prior written consent from the Coach.

Section 10

Dispute Resolution

10.1 Informal Resolution

In the event of any dispute arising from these Terms or the coaching relationship, the parties agree to attempt informal resolution first by notifying the Coach in writing and allowing 30 days for good-faith response.

10.2 Governing Law

These Terms are governed by the laws of the State of California. Any dispute not resolved informally shall be submitted to binding arbitration in Placer County, California, under the rules of the American Arbitration Association.

10.3 Waiver of Class Action

The client waives any right to bring or participate in any class action or collective action against Athletics Anonymous.

Section 11

Modifications

Athletics Anonymous reserves the right to modify these Terms at any time. Clients will be notified of material changes via email. Continued use of services after notification constitutes acceptance of the modified Terms.

Privacy Policy
Section 01

Information We Collect

1.1 Information You Provide Directly

  • Name, email address, phone number, and mailing address
  • Health history, including self-reported medical conditions, injuries, medications, and clinical history
  • Fitness history, training goals, and lifestyle information
  • Bloodwork results or other health data you voluntarily share
  • Payment information (processed by third-party payment processors; not stored by us)
  • Communications via email, text, or coaching platforms

1.2 Information Collected Automatically

  • Website usage data, including pages visited and time on page
  • IP address and browser type
  • Cookies (see Section 8)

1.3 Information From Third Parties

We do not receive your health data directly from Hone Health or any clinical provider. Any clinical information we receive comes from you, the client, voluntarily.

Section 02

How We Use Your Information

  • Deliver, personalize, and improve coaching services
  • Design training and wellness programs tailored to your goals and health status
  • Communicate with you regarding your program, check-ins, and schedule
  • Process payments
  • Comply with legal obligations
  • Improve our services and website

We do not use your health information for marketing purposes without your explicit written consent.

Section 03

Health Information — Special Protections

We treat all health information you share with us with strict confidentiality. While Athletics Anonymous is not technically a HIPAA covered entity (as defined under 45 CFR § 160.103), we voluntarily apply HIPAA-equivalent standards to the handling of your health data:

  • Minimum necessary access — only the Coach reviews your health data
  • Secure storage — health data is stored in encrypted, password-protected systems
  • No sale or sharing of your health data with any third party without your explicit written consent, except as required by law
  • No use of your health data for advertising, marketing to third parties, or data brokerage of any kind
Section 04

Information Sharing

We do not sell, rent, or trade your personal information. We may share your information only in the following circumstances:

  • Service providers: Third-party tools used to deliver services (e.g., email platforms, payment processors, scheduling software) under contractual confidentiality obligations
  • Legal compliance: When required by law, court order, or governmental authority
  • Safety: When disclosure is necessary to prevent imminent harm to you or others
  • With your consent: When you explicitly authorize sharing with a specific third party (e.g., your Hone Health physician)

We will never share your bloodwork, health history, or personal health information with Hone Health or any clinical provider without your explicit, documented written authorization.

Section 05

California Privacy Rights (CCPA / CPRA)

As a California resident, you have the following rights:

  • Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you
  • Right to Delete: Request deletion of personal information we hold about you, subject to certain exceptions
  • Right to Correct: Request correction of inaccurate personal information
  • Right to Opt Out: Opt out of the sale or sharing of your personal information (we do not sell or share personal information)
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights

Section 06

Data Retention

We retain your personal information for as long as necessary to deliver services, comply with legal requirements (minimum 3 years for business records under California law), and resolve disputes. Health information is retained for a minimum of 3 years following the conclusion of the coaching engagement, after which it is securely deleted unless otherwise required by law.

Section 07

Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information, including encrypted storage for health-related data, password-protected access to all client files, and limited access — only the Coach accesses your personal health information. In the event of a data breach affecting your personal information, we will notify you within 72 hours of becoming aware of the breach, as required by California law.

Section 08

Cookies

Our website may use cookies and similar tracking technologies to improve user experience and collect analytics data. You may disable cookies through your browser settings without affecting your ability to use coaching services. We do not use cookies to collect health information or personally identifiable information without your consent.

Section 09

Third-Party Links

Our website may contain links to third-party websites, including Hone Health. We are not responsible for the privacy practices or content of third-party sites. Review their privacy policies independently.

Section 10

Children's Privacy

Our services are intended exclusively for adults aged 18 and older. We do not knowingly collect personal information from individuals under 18. If we become aware that we have collected information from a minor, we will delete it immediately.

Acknowledgment

By engaging Athletics Anonymous services, the client acknowledges that they have read, understood, and agreed to all Terms & Conditions and Privacy Policy provisions contained in this document.
